These Terms & Conditions ("Terms") govern your use of the TYC Golf app and the tradeyourclubs.com website (together, the "Services"), operated by Finlat, LLC dba TradeYourClubs ("TradeYourClubs," "TYC," "we," "us," or "our"), including selling or trading in golf clubs for cash or store credit. By creating an account or using the Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and able to form a binding contract to use the Services.

2. How trade-ins work

• Submit — You submit clubs by providing details and photos.
• Offer — We review your submission and send you a cash offer and a store-credit offer. Offers are estimates based on the information and photos you provide and are subject to inspection.
• Accept & ship — If you accept, we provide a prepaid shipping label. You must ship the clubs promptly and as described.
• Inspection — When your clubs arrive, we inspect them. If they match your submission, we finalize your offer. If they differ, we may send a revised offer, which you can accept or decline.
• Payout — Once approved, we pay you by your chosen method (cash payout or store credit).

3. Offers, inspection, and revised offers

All offers are preliminary and subject to physical inspection. If, on inspection, the clubs' condition, authenticity, model, or completeness differs from your submission, we may revise or withdraw the offer. If you decline a revised offer, we will return your clubs to you; you are responsible for return shipping costs unless we state otherwise. We may reject items that are counterfeit, stolen, damaged beyond stated condition, or otherwise ineligible.

4. Ownership and authority

You represent and warrant that you are the lawful owner of the clubs you submit (or are authorized to sell them), that they are not stolen or subject to any lien or claim, and that you have the right to transfer ownership to us. Ownership of accepted clubs transfers to TradeYourClubs upon payout.

5. Shipping and risk of loss

We provide prepaid shipping labels for accepted trades. You are responsible for properly packaging your clubs. Risk of loss during shipping is handled according to the carrier's terms and our policies; contact us if a shipment is lost or damaged in transit.

6. Cash payouts

If you choose a cash payout, we send payment to the payout method and details you provide (such as Venmo, PayPal, CashApp, Zelle, or bank/ACH). You are responsible for providing accurate payout details, and we are not responsible for payments sent to incorrect details you supply. Payouts are typically issued after inspection and approval.

7. Store credit

• Store credit is issued to your TYC account balance and can be applied toward purchases from TradeYourClubs as described in the app.
• Store credit has no cash value, is non-transferable, and cannot be redeemed for cash except where required by law.
• Redemption occurs when you enable redemption and we apply your credit to a purchase. We may set reasonable limits on redemption.
• We may adjust your balance to correct errors or address fraud or abuse.

8. Prohibited conduct

You agree not to submit items you do not own or are not authorized to sell; provide false or misleading information; submit counterfeit or stolen goods; interfere with or misuse the Services; or use the Services for any unlawful purpose.

9. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us promptly of any unauthorized use.

10. Disclaimers

The Services are provided "as is" and "as available." Offers are not guarantees of final value. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.

11. Limitation of liability

To the fullest extent permitted by law, TradeYourClubs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Services. Our total liability for any claim relating to a trade will not exceed the amount of the offer for the clubs at issue.

12. Changes to the Services and Terms

We may modify the Services or these Terms at any time. If we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of the State of Utah, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in Utah, unless otherwise required by applicable law.
